GENERAL TERMS & CONDITIONS – DRIPLEY

Article 1 – Identity of the Entrepreneur

DRIPLEY is an online store specializing in streetwear, sneakers, accessories, and related products.

Article 2 – Applicability

  1. These general terms and conditions apply to every offer made by DRIPLEY and to every agreement concluded between DRIPLEY and a consumer.

  2. By placing an order, the customer agrees to these general terms and conditions.

  3. Deviations from these terms and conditions are only valid if agreed upon in writing.

Article 3 – The Offer

  1. DRIPLEY takes the utmost care in describing and presenting its products.

  2. Obvious errors, mistakes, or obvious pricing errors in an offer are not binding on DRIPLEY.

  3. Images are for illustrative purposes only. Colors may vary depending on the customer's screen settings.

  4. Products may be new or pre-owned. If a product is pre-owned, this will be clearly stated on the product page.

Article 4 – Formation of the Agreement

  1. The agreement is concluded when the customer places an order and payment has been successfully processed.

  2. DRIPLEY reserves the right to refuse an order in the event of:

    • fraud or suspected fraud;

    • incorrect payment information;

    • a product no longer being available;

    • an obvious pricing error.

  3. If an order cannot be fulfilled, any amount already paid will be refunded.

Article 5 – Prices

  1. All prices stated include VAT, unless otherwise indicated.

  2. Any shipping costs will be clearly displayed before the order is completed.

  3. DRIPLEY reserves the right to adjust prices at any time.

  4. Price changes do not affect orders that have already been placed and paid for.

Article 6 – Payment

  1. Payment must be made in full in advance using the available payment methods.

  2. DRIPLEY accepts, among others:

    • Shopify Payments

    • PayPal

  3. Orders will only be processed once payment has been successfully received.

Article 7 – Delivery

  1. DRIPLEY ships to the Netherlands, Belgium, and other European countries.

  2. Orders are processed and shipped while supplies last.

  3. Stated delivery times are indicative and do not constitute strict deadlines.

  4. If a product turns out to be unavailable, the customer will be informed as soon as possible.

  5. The risk of damage to or loss of the product transfers to the consumer upon delivery.

Article 8 – Right of Withdrawal

  1. Consumers have the right to withdraw from their purchase within 14 days of receiving the order without giving a reason.

  2. Within this period, the customer must notify DRIPLEY in writing of their request to return the order.

  3. After registering the return, the product must be sent back within 14 days.

  4. The direct costs of returning the product are borne by the customer.

Article 9 – Return Conditions

  1. Returned products must:

    • be in the same condition as when they were received;

    • be complete;

    • show no new signs of use;

    • include any applicable labels and accessories.

  2. DRIPLEY reserves the right to refuse returns if:

    • products have been damaged through use;

    • products are incomplete;

    • there is a reduction in value due to use beyond what is necessary to establish the nature, characteristics, and functioning of the product.

  3. Returns will only be accepted after they have been registered in advance.

  4. The return address will be provided after approval of the return request.

Article 10 – Refunds

  1. The refund will be processed after the returned product has been received and inspected.

  2. Refunds will be made using the same payment method used for the original payment.

  3. DRIPLEY aims to process refunds within 14 days of receiving the returned product.

Article 11 – Pre-Owned Products

  1. DRIPLEY sells both new and pre-owned products.

  2. Any signs of use, damage, or differences in condition will be described as accurately as possible in the product description and/or product photos.

  3. By purchasing a pre-owned product, the customer acknowledges that the product is not in new condition.

Article 12 – Authenticity

  1. DRIPLEY only sells products whose authenticity has been checked to the best of its knowledge.

  2. DRIPLEY is an independent reseller.

  3. DRIPLEY is not affiliated with, sponsored by, or officially connected to brands such as Nike, Jordan Brand, Supreme, BAPE, or any other brands mentioned on the website.

  4. All trademarks remain the property of their respective owners.

Article 13 – Warranty and Complaints

  1. Consumers are entitled to a product that meets the reasonable expectations based on the agreement.

  2. Complaints must be submitted in writing within a reasonable period after discovery of the issue via:

  1. DRIPLEY aims to respond to complaints within 14 days.

Article 14 – Liability

  1. DRIPLEY is only liable for direct damage resulting from intent or gross negligence.

  2. To the extent permitted by law, any liability is limited to the amount of the relevant order.

  3. DRIPLEY is not liable for indirect damage, consequential damage, loss of profits, or missed savings.

Article 15 – Force Majeure

  1. DRIPLEY is not obliged to fulfill its obligations if this is reasonably impossible due to force majeure.

  2. Force majeure includes, among other things:

    • disruptions affecting carriers;

    • internet outages;

    • government measures;

    • natural disasters;

    • strikes;

    • war or similar circumstances.

Article 16 – Applicable Law

  1. All agreements between DRIPLEY and the consumer are exclusively governed by Dutch law.

  2. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
